This contract (“Agreement”) is made between Unlimited Health Coaching or here as referred to as the The Unlimited Health Team (“Coaches”) and (“Client”), collectively referred to as “Parties,” for the provision of Unlimited Health Coaching services. Both Parties agree to the terms and conditions outlined below:
1. Services:
The Coach agrees to provide unlimited health team services to the Client, which may include personalized health assessments, goal setting, behaviour modification strategies, nutrition guidance, exercise planning, and ongoing support. The services will be provided by the Coach or a suitable replacement from the Unlimited Health Coaching Team.
2. Coach Selection:
The Coach will make every effort to match the Client with a suitable coach based on the Client’s needs, preferences, and goals. If the initial coach assigned to the Client is not a good fit, the Coach will promptly assign another coach from the Unlimited Health Coaching Team until a suitable match is found. The Client agrees to provide timely feedback regarding their coaching experience to facilitate the selection process.
3. Confidentiality:
The Coach agrees to maintain the confidentiality of all personal information shared by the Client during the coaching sessions, except as required by law or with the Client’s written consent. The Client acknowledges that the Coach may consult with other team members or professionals, strictly for the purpose of providing the best possible coaching experience.
4. Course Cancellation Policy:
The Client understands and agrees to the following cancellation policy:
a. The Client is entitled to one free cancellation of a scheduled coaching session, provided that a minimum of 24-hour notice is given before the session start time.
b. Any subsequent cancellations made by the Client within 24 hours of the scheduled session will result in the forfeiture of that session.
c. In the event of a cancellation by the Coach, the Client will be promptly notified, and a suitable replacement session will be scheduled at the earliest convenience.
5. Client Responsibilities:
The Client acknowledges that achieving health and wellness goals requires active participation and commitment. The Client agrees to:
a. Be honest and open during coaching sessions, providing accurate information necessary for effective coaching.
b. Take responsibility for their own decisions and actions related to health and wellness.
c. Communicate any concerns or issues regarding the coaching process promptly and directly with the Coach.
6. Limitation of Liability:
The Client acknowledges that health coaching services are not intended to replace medical advice, and the Coach is not a licensed healthcare professional. The Client assumes full responsibility for their own well-being and should consult a healthcare provider before making any significant changes to their lifestyle, diet, or exercise routine. The Coach/Independent Contractor and the Unlimited Health Team shall not be liable for any direct or indirect damages, losses, or injuries arising from the services provided.
7. Coach Replacement and Refund Policy:
In the event that the initial coach assigned to the Client is not a suitable fit, the Coach will make every effort to find a suitable replacement coach from the Unlimited Health Team. The Client acknowledges and agrees that the Coach will work diligently to ensure the Client is matched with a coach who can meet their needs. However, if a suitable replacement coach cannot be found, the Client understands that all remaining coaching sessions will be forfeited, and no refunds will be provided. The Client’s satisfaction is of utmost importance, and the Coach guarantees to find the right coach from the Unlimited Health Team to fulfill the Client’s needs as stated in Point 3 of this Agreement.
8. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the home state of the respective independent contractor. The Parties agree that this governing law is chosen to serve the best interests of both the Coach and the Client. Any disputes arising from this Agreement shall be resolved amicably through negotiations between the Parties. In case of failure to reach an amicable resolution, either Party may initiate legal proceedings in the appropriate jurisdiction as determined by the governing law.
9. Acknowledgement of Voluntary Participation:
This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
The Client acknowledges that their decision to engage in the Unlimited Health Coaching services provided by the Coach or the Unlimited Health Team is voluntary. If the Client was directed to this website or program by their company or business, unless otherwise stated, it is the Client’s sole discretion and choice to continue with the coaching program. The Client understands and agrees that their company or business shall not be held liable for any outcomes, actions, or consequences resulting from their participation in the coaching program.
10. Modifications:
Any modifications to this Agreement shall be made in writing and signed by both Parties.
11. Infringement:
The Coach owns or has rights to all the materials and content provided as part of the Unlimited Health Coaching services. The Client agrees not to copy, modify, distribute, or use the Coach’s materials without permission. If the Client violates these rights, the Coach may take legal action and seek compensation for any damages. The Client also agrees to not infringe on any copyrights, trademarks, or trade secrets of the individual Coach or The Unlimited Health Team.
By e-signing, you acknowledge that they have read, understood, and agree to the terms and conditions of this Agreement.
